What is the Mental Capacity Act?
The Mental Capacity Act (MCA) 2005 is designed to protect and empower individuals who may lack the mental capacity to make their own decisions about their care and treatment. It is a law that applies to individuals aged 16 and over.
Examples of people who may lack capacity include those with:
Dementia,
A severe learning disability,
A brain injury,
A mental health condition,
A stroke, and
Unconsciousness caused by an anaesthetic or sudden accident
However, just because a person has one of these conditions does not necessarily mean they cannot make a specific decision.
Someone can lack the capacity to make some decisions (for example, to decide on complex financial issues) but still can make other decisions (for example, to determine what items to buy at the local shop).
What is the Deprivation of Liberty Safeguards?
The Deprivation of Liberty Safeguards is an amendment to the Mental Capacity Act 2005. They apply in England and Wales only.
The Mental Capacity Act allows restraint and restrictions to be used – but only if they are in a person’s best interests.
Extra safeguards are needed if the restrictions and restraint used will deprive a person of their liberty. These are called the Deprivation of Liberty Safeguards.
The Deprivation of Liberty Safeguards can only be used if the person will be deprived of their liberty in a care home or hospital. In other settings, the Court of Protection can authorise a deprivation of liberty.
Care homes or hospitals must ask a local authority if they can deprive a person of their liberty. This is called requesting a standard authorisation.
What is the Mental Capacity Act Code of Practice?
The code of practice gives guidance to people who:
Work with people who can’t make decisions for themselves
Care for people who can’t make decisions for themselves
It says what you must do when you act or make decisions on behalf of people who cannot act or make those decisions for themselves.
The Mental Capacity Act 2005 (MCA) says certain people must think about the code of practice when they act or make decisions on the other person’s behalf. This includes:
An attorney appointed under a lasting power of attorney
A deputy appointed by the Court of Protection
An independent mental capacity advocate
A person doing research approved following the MCA
A person who acts in a professional capacity for, or about, people who can’t make decisions for themselves
A person who is paid to act for or concerning people who cannot make decisions for themselves.
Why is the online Mental Capacity Act training important?
The Mental Capacity Act aims to empower and protect people who may not be able to make some decisions for themselves. It also enables people to plan ahead in case they are unable to make crucial decisions for themselves in the future.
All healthcare and social care workers need to understand the Mental Capacity Act and Deprivation of Liberty Safeguards (DoLS).

Continuing Professional Development (CPD) accreditation benefits both employees and employers. The main advantages are as follows:
Keeping employee skills up-to-date.
Maintaining professional standards.
Building employee confidence.
Enhancing career advancement.
Improving job satisfaction.
Maintaining high standards across the organisation.
Meeting regulatory and legislative requirements.
Improving employee commitment to their jobs.
Sharing best practice across the organisation.
For employees, CPD helps to keep their knowledge and skills up-to-date. It also contributes to maintaining the professional standard of their qualifications, registrations and sense of direction. Moreover, completing CPD helps employees to build their confidence and credibility. It empowers them to showcase their achievements and provides them with tools to cope with change positively. In most sectors, CPD is beneficial for employees’ career progression and advancement. Many studies have found that evidence of CPD improves career prospects, such as promotions or specialism. In real terms, this means that CPD contributes to achieving job satisfaction and higher salaries.
For employers, the main advantage of CPD is the security of sustaining high standards across the whole organisation. CPD can help ensure consistent standards to meet regulatory and statutory requirements. It also improves employees’ commitment to their job roles and promotes greater work engagement from the workforce. Organisations that provide CPD, whether concurrently or over some time, allows for the sharing of best practice and support. Also, it contributes to maximising staff potential, improving staff morale and providing a useful benchmark for annual appraisals.

The Office of Qualifications and Examinations Regulation (Ofqual) is a non-ministerial government department (HM Government) that regulates qualifications, examinations and tests/assessments in England and, until May 2016, vocational qualifications in Northern Ireland. Colloquially and publicly, Ofqual is often referred to as the exam “watchdog”. Ofqual regulates all the awarding bodies in the UK.
The Department for Children, Education, Lifelong Learning and Skills is an established subdivision of the Welsh Government. It is responsible for education, training and children’s services in Wales under powers devolved from the Department for Children, Schools and Families of the UK government under Schedule 5 of the Government of Wales Act 2006. It is headed by the Minister for Education (Welsh Government).
All our statutory and mandatory training courses for health and social care are aligned to the UK Core Skills Training Framework (CSTF).
With a highly mobile workforce, health and social care employers often need to identify recruits’ previous statutory and mandatory training. Where the training information is lacking, some staff can repeat training unnecessarily, wasting time and money. The UK CSTF was launched in 2013 to address this issue. It allows health and social care employers to recognise statutory/mandatory training to a standard, trust that information and reduce duplication of training.
