People living with mental health conditions are people. They have people they love, activities they enjoy and dreams for their lives. As people, they deserve to be treated with dignity, and under the law, they have rights and protections.

Deinstitutionalisation is a government policy that moved mental health patients out of state-run “insane asylums” into federally funded community mental health centres. It began in the 1960s as a way to improve the treatment of the mentally ill while also cutting government budgets.

The term institutionalisation can both be used to the process of committing an individual to a mental hospital or prison or the institutional syndrome. Committal to a mental institution is very much a thing of the past but occurs in a small number of cases taking the psychiatric population as a whole.

Section 3 of the Mental Health Law is commonly known as “treatment order”. It allows the detention of the service user for treatment in the hospital-based on specific criteria and conditions being met.
